Navigating Your Inhalation Patents through the European Patent Office

Abstract:
Obtaining a patent from the European Patent Office (EPO) requires specific procedural steps that are well defined. These steps are the same for applications covering inhalation products as for applications covering other types of inventions. However, some inhalation patents have been revoked by the EPO Board of Appeals (EPO Board) for failing to meet certain EPO requirements. This article will outline the general pathway and requirements for obtaining an EPO patent, survey some of the recent decisions of the EPO Board involving inhalation patents and offer recommendations for improving EPO applications. Most importantly, including a detailed description of the invention in the application will greatly enhance the chance of successfully navigating the EPO and acquiring a strong inhalation patent.
